By accessing our website or booking services, you agree to these Terms together with the policies applicable to the service you purchase.
SHAVAT METHOD™ professional practitioner training is governed by our separate Professional Training Terms & Certification Agreement. Where there is any inconsistency relating to a professional training booking, the Professional Training Terms & Certification Agreement will take precedence.
1. Website Use
You must use our website lawfully and must not:
interfere with its operation or security;
transmit malicious software or code;
use our content in violation of intellectual property rights;
collect another person's personal information unlawfully; or
use the website for fraudulent or unlawful purposes.
We may restrict access where reasonably necessary to protect our website, business, clients or legal rights.
2. Intellectual Property
Unless otherwise stated, content created by or for Shavat Uplift, including original text, photographs, graphics, educational materials, treatment materials, course materials and proprietary SHAVAT METHOD™ content, remains the intellectual property of Shavat Uplift and/or the relevant rights holder.
Website access or purchase of a service does not transfer ownership of intellectual property.
Content may not be reproduced, sold, distributed, republished or commercially exploited without permission except where expressly permitted by law or by a separate written agreement.
Rights granted to Certified SHAVAT METHOD™ Practitioners are governed by the Professional Training Terms & Certification Agreement.
3. Information & Wellness Content
Information provided on our website, social media or educational materials is intended for general educational and wellness purposes.
It does not constitute medical advice, diagnosis or medical treatment.
You should seek advice from an appropriately qualified healthcare professional regarding medical concerns.
Although we take reasonable care in preparing information, website content may occasionally require correction or updating.
4. Pricing & Service Changes
Current prices and service descriptions are displayed through our website or relevant booking platform.
We may change future prices, services, availability or descriptions.
Changes will not alter the agreed price of a booking already confirmed unless agreed with you or otherwise permitted by law.
If we cancel a confirmed service and cannot provide a suitable alternative, the applicable cancellation policy and statutory rights will apply.
5. Treatments & Services
Treatments and wellness services are subject to availability and individual suitability.
We may reasonably decline, postpone or modify a treatment where necessary because of contraindications, safety concerns, professional scope, inappropriate conduct or another lawful reason.
Images and treatment examples are illustrative. Individual physiological and visible results vary and are not guaranteed.
6. Bookings, Payments & Account Information
You are responsible for providing accurate booking and contact information.
Where advance payment or a deposit is required, the booking will be confirmed in accordance with the conditions displayed during booking.
Cancellations, rescheduling, transfers, refunds and returns for treatments, workshops and products are governed by our Booking & Cancellation Policy.
Professional training payments, payment plans, cancellations and transfers are governed separately by the Professional Training Terms & Certification Agreement.
We may reject or investigate transactions that reasonably appear fraudulent or unauthorised.
7. External Platforms & Third-Party Services
Our website and business may use third-party services including booking platforms, payment processors and other technology providers.
Their services may be governed by their own terms and privacy policies.
We are not responsible for failures or acts of independent third-party providers except to the extent responsibility cannot lawfully be excluded.
8. Personal Information
Our collection and processing of personal information is governed by our Privacy Policy.
9. Prohibited Activities
You must not use our website or services to:
commit or encourage unlawful acts;
infringe intellectual property rights;
harass, threaten, abuse or unlawfully discriminate against others;
collect personal information unlawfully;
distribute malicious software;
impersonate Shavat Uplift or falsely claim an official relationship with us; or
use SHAVAT METHOD™ intellectual property in a manner not authorised by us or by applicable law.
10. Treatment, Health & Safety
SHAVAT METHOD™ treatments, including techniques incorporating Bojin, fascia release and lymphatic drainage, are provided for wellness and aesthetic purposes.
They do not constitute medical diagnosis or medical treatment.
Clients are responsible for providing relevant and accurate information concerning health conditions, allergies, medication, pregnancy, injuries, recent surgery, cosmetic procedures or other contraindications where reasonably requested.
Shavat Uplift is not responsible for an adverse outcome to the extent that it results from material health information being withheld, failure to follow reasonable safety or aftercare instructions, or another matter for which responsibility may lawfully rest with the client.
Nothing in these Terms limits our responsibility to provide services with reasonable care and skill.
11. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights and remedies that cannot lawfully be excluded.
Subject to applicable law, Shavat Uplift will not be responsible for losses that were not reasonably foreseeable when the relevant contract was entered into.
Where services are purchased wholly or mainly for business purposes, additional limitations or responsibilities may apply as permitted by law.
12. Business Use
Where you use our website or services wholly or mainly in connection with a business, you remain responsible for ensuring that your use complies with applicable law and does not infringe our intellectual property or other rights.
Nothing in this Section applies so as to exclude liability or impose an obligation where doing so would be unlawful.
13. Governing Law
These Terms are governed by the laws of England and Wales.
Where you are legally acting as a consumer, nothing in this provision removes mandatory consumer protection, jurisdiction or access-to-court rights that apply to you.
14. Relationship Between Our Policies
These Terms should be read together with our:
Privacy Policy;
Booking & Cancellation Policy (treatments, workshops and products);
